Terms of Service

Please read these Terms of Service carefully before enrolling. By enrolling in any Hernando Senior Wellness service plan, submitting an inquiry, or using this website, you agree to be bound by these Terms.

1. About Our Service

Hernando Senior Wellness provides non-clinical, private-pay Homemaker & Companion Services (HCS) in Hernando County, Florida, registered with the Florida Agency for Health Care Administration (AHCA) under applicable HCS regulations.

Important — Scope of Service: Our wellness visitors are not licensed medical professionals, nurses, therapists, or home health aides. We do not provide medical care, nursing services, physical therapy, or clinical assessments of any kind. Our visits are observational, companionship-based, and safety-oriented. Nothing communicated by our visitors, in our reports, or on this website constitutes medical advice, diagnosis, or treatment.

2. Eligibility and Enrollment

Our services are available to adults aged 18 and over enrolling on behalf of themselves or a senior family member. You represent that you have the legal authority to enroll the senior in our services and to agree to these Terms on their behalf.

Enrollment is complete when payment is successfully processed and confirmed via our WooCommerce / Stripe checkout. We will contact you within 24 business hours of enrollment to schedule the first visit.

3. Service Plans and Pricing

Prices are in U.S. dollars. We reserve the right to adjust pricing with 30 days' advance notice to enrolled clients. Annual Plan clients who have signed a service agreement will not be subject to mid-term price changes.

4. Payment and Billing

All payments are processed securely via Stripe. We store only the last 4 digits and card brand; full card numbers are never stored on our servers.

  • One-time plans (Single Visit, Bi-Weekly, Flexible Pack, Full Year Prepay): Charged in full at time of enrollment.
  • Monthly Wellness Plan: Charged monthly on the anniversary of your enrollment date. May be cancelled with 7 days' written notice before the next billing date.
  • Annual Monthly Payments: Charged monthly for exactly 12 consecutive billing cycles. The subscription automatically cancels after the 12th payment — no action required from you.

If a payment fails, we will attempt to re-process once and notify you by email. If the second attempt fails, visits may be paused until the billing issue is resolved.

5. Cancellation and Refund Policy

Non-refundable after visit completion: Visits that have already been completed are non-refundable. If a visit was scheduled but not completed due to our error, we will either reschedule or credit your account.

Monthly Wellness Plan cancellation: Cancel anytime with 7 days' written notice to info@vatiyk.com before your next billing date. Visits remaining in your current paid billing period will be honored.

Annual Care Agreement cancellation: Annual Plans require a signed service agreement. Early cancellation of an Annual Plan (Monthly Payments or Full Year Prepay) may be subject to an early termination fee as specified in your signed service agreement. Contact us to discuss your circumstances — we will always try to work with you.

Refunds: Unused visits on one-time plans (Single Visit, Bi-Weekly, Flexible Pack) may be refunded within 30 days of purchase if no visit has been scheduled or completed. After 30 days or after a visit has been completed, all sales are final.

6. Scheduling and Visit Policies

  • We operate Sunday through Friday. We do not currently offer Saturday visits.
  • We will make every reasonable effort to honor scheduled visit times. If we need to reschedule due to staffing, weather, or unforeseen circumstances, we will notify you with as much advance notice as possible and reschedule at no additional cost.
  • If the senior or responsible party cancels a visit with less than 24 hours' notice more than twice in a calendar month, we reserve the right to apply a $20 late cancellation fee per missed visit.
  • For the safety of our visitors, visits may be declined or terminated if the environment is unsafe (e.g., threatening behavior, uncontrolled animals, or biohazard conditions).

7. Limitation of Liability

Hernando Senior Wellness provides non-clinical, observational services only. We are not responsible for, and expressly disclaim liability for:

  • Medical conditions, diagnoses, or health outcomes of enrolled seniors
  • Falls, injuries, or accidents that occur outside of our scheduled visit times
  • Any misunderstanding of our reports as constituting medical advice or clinical assessment
  • Reliance on our visit reports as a substitute for medical evaluation or emergency services

In the event of an emergency observed during a visit, our visitors will call 911 and immediately notify the designated emergency contact. Our liability for any claim arising from our services shall not exceed the total amount paid by the client in the 3 months prior to the event giving rise to the claim.

8. Privacy

Your use of this site and enrollment in our services are also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Safe Surroundings Observation — Non-Professional Disclaimer

Our Safe Surroundings walkthrough is a visual, non-professional safety observation intended to identify obvious hazards (loose rugs, lighting issues, grab bar stability, etc.) for communication to the family. It is not a professional home inspection, structural assessment, or engineering evaluation, and should not be relied upon as such. Findings are shared informally with the designated family contact and do not constitute professional reports under Florida Chapter 468 or any other professional licensing statute.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Florida. Any disputes arising from these Terms or our services shall first be submitted to good-faith mediation in Hernando County, Florida, before any litigation is pursued. The prevailing party in any dispute may be entitled to reasonable attorney's fees.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our services after a change to these Terms constitutes acceptance of the revised Terms. For material changes affecting enrolled clients, we will provide 30 days' advance written notice by email.
